Roger Mentch, who was recently denied a caregiver defense in a landmark decision by the CA Supreme Court, has been re-arrested.


Roger's case illustrates how, even though DEA raids may be ending, state law enforcement presents a major threat to medical marijuana providers, especially now that the caregiver defense has been undercut by the Supreme Court. Roger's crime was to sell medical marijuana to a patient with a valid ID who happened to be a Santa Clara Co. undercover cop; a greenhouse with 157 plants was subsequently found at his property. State law does not protect distribution of MJ except in defined situations involving coops, collectives, and caregivers. A strict reading of this law rules out much of the selling activity that is currently going on. Delivery services are particularly vulnerable, as we have seen in San Diego, where the police recently arrested several providers. Roger may well have been singled out as a target because of his previous high-profile case; it is certainly peculiar that he was busted by Santa Clara sheriffs when he lives in Santa Cruz County.
