By using the Medical Marijuana of America, hereafter MMA, software and/or site related services, you agree to be bound by the following terms and conditions:
GOVERNMENT OR LAW ENFORCEMENT AGENTS MAY NOT REGISTER TO ENTER THE MEMBER ONLY SECTIONS OF THIS WEBSITE
My registration affirms and certifies that I am not a law enforcement agent or official, nor am I associated with any law enforcement agency. I understand this statement applies to me even if I am operating under cover of a false identity, through an informant or as an informant, or any other device to conceal my identity and/or affiliation with any government agency. I personally accept full legal civil responsibility for any legal action that may arise as the direct or indirect result of my use of this website. I understand this means I may be liable to civil prosecution for monetary damages arising out of my use of this website and/or any information or material obtained from it.
Terms of Service Rules: (added 12/21/2006)
1. You may not harm or exploit minors in any way. Use of the MMA software or site related services to harm or exploit minors in any way is not allowed and in violation of the law. The MMA software is restricted to use by users eighteen (18) and older. The MMA site related services may not be used by any user under the age of thirteen (13). The MMA site related services may not be used by users between the ages of thirteen (13) and eighteen (18) without adult supervision.
2. You may not use MMA for illegal purposes. MMA software and site related services may not be used for illegal purposes or to support illegal activities. MMA reserves the right to cooperate with legal authorities, and/or any injured third parties in the investigation of any criminal activity.
3. Disputes with MMA users. How you choose to interact with other MMA users is your sole responsibility. MMA has no obligation to monitor disagreements between you and other MMA users.
4. You may not make threats. Making threats against others or encouraging bodily harm or destruction of property is absolutely forbidden.
5. Obscene, nude or offensive photos, videos, and profiles are absolutely forbidden.
6. Impersonating a MMA employee is absolutely forbidden. MMA employees will never ask you for your logon, password, or credit card.
7. You may not use MMA web services or MMA software to spam others. Spam includes sending many identical unsolicited messages to others, or creating MMA profiles in order to send traffic to a specific website or affiliate program without MMA's express written permission.
8. Copyright or trademark infringement is absolutely forbidden. You may not upload or transmit any material that infringes on any copyright, trademark, patent, or any proprietary rights of any party. To report trademark or copyright infringement please visit our contact page which can be found at http://www.medicalmarijuanaofamerica.com under the link "contact."
9. Accessing unauthorized MMA accounts and services is absolutely forbidden. You may not attempt to logon to accounts which are not yours.
10. You may not use the MMA software or site related services to collect or attempt to collect personal information about third parties without their knowledge and consent.
11. You may not use the MMA software or site related services to commit or attempt to commit fraud. You may not knowingly mislead others with the intent that the other party will act on it.
12. In order to use the MMA service, MMA will grant you a User ID, Password and Account. You are solely responsible for maintaining the confidentiality of your User ID and Password. You may not share your logon and password with others so they can access your account. You are responsible and liable for all activities conducted through your User ID, Password and Account, even if this occurs without your permission. If a child under thirteen (13) years of age has access to your computer, do not save your MMA password on your computer. Not saving your password will help to restrict children and any other unauthorized user from using your account. In addition, we strongly recommend that you check regularly to see if any new, unauthorized accounts have been created under your MMA account.
13. You may not act in a way that impedes others from communicating through video chat rooms, our MMA directories, or with the MMA software.
14. You may not interfere with or disrupt the MMA servers or services in any manner whatsoever. Doing so may be a violation of Federal law.
15. YOU ACKNOWLEDGE THAT MMA DOES NOT PRESCREEN USER PROFILES OR VIDEO CHAT ROOMS AND HAS NO CONTROL OVER USER PROFILE OR VIDEO CHAT ROOM CONTENT OR AVAILABILITY. VIEWING MMA PROFILES AND ENTERING ADS IS DONE AT YOUR OWN RISK. SOME MMA SITE RELATED SERVICES AND/OR ADS ARE NOT SUITABLE FOR USERS UNDER THE AGE OF EIGHTEEN (18) YEARS OF AGE. MMA HAS TAKEN EVERY REASONABLE STEP TO INSURE THAT SUCH AREAS ARE NOT AVAILABLE TO USERS UNDER THE AGE OF EIGHTEEN (18) YEARS OF AGE. IF YOU ARE UNDER THE AGE OF EIGHTEEN (18) YEARS OF AGE AND SOMEHOW DO ACCESS A SITE RELATED SERVICE OR CHATROOM MARKED "18+" YOU MUST EXIT SUCH SERVICE OR CHATROOM IMMEDIATELY, AND NOTIFY MMA OF YOUR ACCESS. MMA RESERVES THE RIGHT TO REQUEST FURTHER INFORMATION FROM YOU IN AN EFFORT TO FURTHER ASSURE SUCH SITE RELATED SERVICE OR ADS CANNOT BE ACCESSED BY USERS UNDER THE AGE OF EIGHTEEN (18).
16. You may not use software other than MMA software to connect to the MMA network.
17. You may not use MMA software or site related services to transmit viruses or any other malicious programs. Doing so may be a violation of Federal law.
18. You may not share your MMA Pro serial numbers with others. Please keep your serial number private. Only one person can be logged on to the MMA network at a time using one serial number. If more than one person tries to use the same serial number at the same time you will both be disconnected from the MMA service. If you share your serial number with others and this sharing causes you to be constantly disconnected from the MMA network MMA can't and won't reissue you another serial number.
19. You may not use the MMA website or site related services to disparage or damage the reputation of MMA or MMA employees, contractors, agents, officers or directors.
20. If you do not logon to MMA for 6 months your nickname may be deactivated.
21. Use of MMA is solely for your personal, non-commercial use only. You may not use the MMA software or site related services to generate income in any manner. MMA shall not be liable to any third party that creates or implements any helper application software for use with MMA. The sole exception to this clause is for paid advertisers subject to additional terms and conditions provided to them upon application for advertising services.
22. MMA reserves the right to modify or change the MMA software and site related services without notice. MMA shall not be liable to you or any third party for changes in our software or site related services.
23. These Terms of Service will be interpreted and governed by the laws of the State of California. You agree that any legal dispute involving MMA software and/or site related services must take place in State or Federal courts in Sacramento County, California. You agree to waive any objection to personal jurisdiction, and agree that venue shall be in Sacramento County, California. MMA's liability to you for any cause whatsoever, no matter the form of the action, will at all times be limited to the amount paid, if any, by you to MMA for products and services during your membership.
24. These Terms of Service, along with any applicable MMA software license and agreement, constitute the entire agreement between the parties and supersede any prior written or oral understanding or agreements.
25. MMA reserves the right to remove or disable any profiles or images that in MMA's opinion violate any of these Terms of Service, or any term of the accompanying license and/or agreement.

The WEBSITE was created and is maintained by awebiz.com which is headquartered in the State of California, in the United States of America, hereinafter referred to as AWEBIZ. Governing Law
These TOS shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to these terms shall be filed only in the state or federal courts located in the Harris county of the State of California and you hereby consent and submit to the personal jurisdiction of such courts for the purpose of litigating any such action. If any provision of these TOS shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between you and AWEBIZ relating to the subject matter herein and shall not be modified by USER except in writing and signed by both parties. The TOS will inure to the benefit of AWEBIZ successors, assigns and licensees.
Indemnification
You agree to hold agree to indemnify, defend and hold harmless MMA and AWEBIZ, along with their officers, directors, employees, consultants, and agents from any and all third party claims, liability, damages and/or costs (including, but not limited to, attorneys fees) arising from your use of WEBSITE or your violation of the terms or conditions of this agreement (the TOS).
